The natural gas consumer is obliged to:
– comply with the requirements of the Natural Gas Supply Rules;
– ensure compliance with the discipline of natural gas selection (consumption) in the volumes and on the terms specified in the contracts;
– timely and in full pay for the delivered natural gas on the terms specified in the contracts;
– implement a set of measures aimed at preventing the emergence of a threat to life or injury, damage to equipment and products, negative environmental consequences, etc. in the event of receiving a notification of the termination (restriction) of the supply (distribution/transportation) of natural gas;
– ensure the admission of supplier representatives upon presentation of an official ID card to the territory of their own facilities to verify data on actual natural gas consumption;
– independently limit (stop) natural gas consumption in cases of:
– violation of payment terms under a contract for the supply of natural gas;
– absence of a consumer in the billing period in the Register of any supplier on the GTS Operator's information platform;
– exceeding the confirmed volume of natural gas without agreement with the supplier;
– absence of a concluded natural gas supply contract;
– in other cases provided for by applicable law.
A natural gas consumer has the right to:
– to receive natural gas in the volumes specified in the natural gas supply contract, subject to compliance with its terms;
– for the simultaneous receipt of natural gas from several suppliers at one commercial metering point, which is assigned a separate EIC code, in one settlement period in the manner established by Clause 22 of Section II of the Natural Gas Supply Rules, subject to the conclusion of a natural gas supply contract with such suppliers and after concluding an allocation agreement with them in accordance with the requirements of the Gas Transportation System Code;
– to receive free information about the supplier's prices for natural gas and the payment procedure;
independently stop (limit) the withdrawal of natural gas for its own needs in compliance with the requirements of current legislation, of which it must notify in writing all natural gas market entities with which relevant contracts have been concluded;
– demand the resumption of natural gas supply in accordance with the established procedure after eliminating violations and compensating for the payment of services for disconnection and connection, if the termination of gas supply occurred without terminating the natural gas supply contract;
– other rights provided for by applicable law.
Rights and obligations of a natural gas supplier
The natural gas supplier has the right:
– to conclude a natural gas supply contract with any consumer and, in the absence of overdue debts of the consumer for natural gas to the current supplier, to supply natural gas to the consumer in the period following the period of natural gas supply by the current supplier;
– receive timely payment for natural gas from the consumer in accordance with the terms of the contract;
to unhindered access (upon presentation of an official ID card) to commercial natural gas metering units installed at the consumer's gas consumption facilities, for the purpose of verifying data on actual natural gas consumption;
– for complete and reliable information from the consumer with whom the contract has been concluded regarding natural gas consumption regimes;
– to initiate the procedure for terminating (restricting) the supply of natural gas to the consumer in accordance with the terms of the contract for the supply of natural gas and in accordance with the requirements of the Rules for the Supply of Natural Gas;
– other rights provided for by applicable law.
The natural gas supplier is obliged to:
– comply with the requirements of the Natural Gas Supply Rules;
– ensure the supply of natural gas under the terms specified in the natural gas supply contract;
– ensure, in accordance with the requirements of the Gas Transmission System Code, timely registration of the consumer in its own Register of Consumers on the information platform of the GTS Operator, provided that the consumer complies with the natural gas supply contract concluded with the supplier;
– in accordance with the established procedure, consider consumer requests regarding activities related to the supply of natural gas;
timely provide the consumer with reliable information, including that provided for by the Law of Ukraine «On the Features of Access to Information in the Spheres of Electricity Supply, Natural Gas, Heat Supply, Centralized Hot Water Supply, Centralized Drinking Water Supply and Water Drainage», as well as data on actual charges (volume and cost) for gas supply services, in order to enable the consumer to regulate his own natural gas consumption. Measures for providing information to the consumer must be provided for in the natural gas supply contract. No additional costs for providing information are paid by the consumer;
– timely notify the consumer if the supplier is in the process of liquidation or bankruptcy, or the supplier is undergoing the procedure of suspension/cancellation of the natural gas supply license, or its license to conduct natural gas supply activities has been canceled or its operation has been suspended, and about the absence of natural gas resources;
– comply with minimum standards and requirements for the quality of service to natural gas consumers;
– offer the consumer under the natural gas supply contract a choice of payment methods for the natural gas supplied and consumed, including bank payment service, online transfer, postal order, cash deposit into the supplier's account at the cash desk and/or other methods, the agreement of which must be fair, transparent and non-discriminatory between consumers;
– create contact points to provide information to consumers. The contact details and operating hours of each contact point must be provided in the natural gas supply contract and on the supplier's website on the Internet;
provide the consumer with a final bill (invoice) after changing the supplier or terminating the natural gas supply contract no later than six weeks after such change or termination of the contract;
– in the event of initiating the exclusion of a consumer from the Supplier's Consumer Register, promptly (simultaneously with the notification to the GTS Operator in accordance with the requirements of the Gas Transportation System Code) notify the consumer of the commission of such actions;
– conclude an agreement on the termination (restriction) of natural gas supply with the GDM Operator, in whose gas distribution area the consumer of such supplier is located;
– perform other duties stipulated by applicable law.
